User Agreement and Terms of Service

Please read the following Terms and Conditions of Use ("Terms" or "Agreement") carefully before accessing or using the HKC website ("Website").

This website, mobile applications and all the functions and other services provided by them are owned and operated by HKC. By using or otherwise accessing this website, mobile application or other content, you acknowledge and agree that: (1) you have read and understood all the terms and conditions in this agreement, as well as all the contents of all the obligations and rules that may be contained or mentioned therein; (2) You will abide by these terms and be bound by them; (3) You agree that we collect, use, disclose and otherwise process the information described in the privacy policy; (4) You meet the qualification requirements specified in Section 1.1 below; (5) This clause is a binding agreement between HKC and you. 1; And (5) this clause is a binding agreement between HKC and you. If you do not agree to these terms at any time, you must immediately stop and give up using and/or otherwise accessing the HKC service.

HKC may modify this clause by sending you an email, providing a notice through the service or updating the "last updated" date at the beginning of this clause on the website. By using or otherwise accessing this website, mobile applications or other content, you confirm your agreement to the revised terms. HKC encourages you to read these terms frequently to ensure that you understand the terms and conditions applicable to your access to and use of HKC services.

Trading or holding digital currency may have the risk of significant financial losses, including but not limited to the risks listed in Appendix 4 below. Therefore, you should carefully consider whether trading or holding digital currency is suitable for you according to your financial situation, risk tolerance and other financial considerations, and obtain corresponding professional, financial, investment and legal advice before making any decision to hold or trade digital currency. You hereby guarantee and declare that you have not received and will not receive any professional, financial, investment or legal advice from HKC, and you will receive all such advice separately.

HKC basic services.

1. qualifications.

1.1.1 You must be at least 18 years old to be eligible to use the HKC service. You represent and guarantee that (a) you have reached the legal age for signing a binding contract, that is, at least 18 years old; (b) It has not been suspended or disqualified from using the HKC service before; And (c) has full power and authority to agree to these terms.

1.1.2 If you are located in the United States of America or any state, country, territory or other jurisdiction forming a part of the United States of America, or if your use of the HKC service in it would be illegal or violate any applicable laws, or if you are a citizen or resident of such jurisdiction, you may not use the HKC service. You represent and warrant that you are not a citizen or resident of any such jurisdiction, and that you will not use the HKC service when you are located in any such jurisdiction. If you are located in any other jurisdiction or a citizen or resident of that jurisdiction where the use of HKC services is prohibited at HKC's sole discretion, you may not use HKC services.

At present, it is envisaged that HKC services will be used by individuals, citizens or residents in different countries according to the registration procedures. HKC may, at its sole discretion, change, expand or reduce the list of such countries from time to time, and HKC may implement controls to restrict access to HKC services from any jurisdiction prohibited by this section.

1.2. HKC service.

Your HKC account ("HKC account") includes the following services ("HKC service"): (i) allowing users to store certain supported wallets in digital currency, such as Bitcoin or Ethereum (corresponding "digital currency" and "digital currency Wallet"); (ii) Tracking, transferring and managing supported digital currency; And (iii) digital currency exchange service, through which users can buy and sell digital currency ("exchange service") in transactions with HKC. These HKC services may be changed, completely terminated and/or other services may be added at HKC's sole discretion.

Create a HKC account.

2.1. Register a HKC account. In order to use the HKC service, you need to register a HKC account. During the account registration process, we will ask you to provide information, including your name and other personal information, to verify your identity. You must provide complete and true information. We may, at our sole discretion, refuse to open a HKC account for you and/or limit the number of HKC accounts you can hold.

2.2. Authentication. During the registration of your HKC account, you must provide the information we require for authentication (including KYC) and detection of money laundering (AML), terrorist financing, fraud or any other financial crimes, and allow us to keep records of such information, including signing the HKC KYC/AML policy and any documents required under it. Before allowing you to use the HKC service, you need to complete some verification procedures. Your access to HKC services and the restrictions applicable to your use of HKC services may change due to the continuous collection of information about you. The information we require may include some personal information, including but not limited to your name, address, telephone number, e-mail address, date of birth, taxpayer identification number, government identification certificate and information about your bank account (such as bank name, account type, routing number and account number). Our authentication third-party partner is Jumio, which will collect telephone numbers and other information so as to use "..." for authentication. By providing us with this information or any other information, you confirm the accuracy and authenticity of the information. If any information you provide changes, you agree to inform us immediately. You authorize us to make inquiries that we think are necessary, directly or through a third party, to verify your identity or protect you and/or us from fraud or other financial crimes, and take actions that we reasonably think are necessary according to the inquiry results. When we make these inquiries, you acknowledge and agree that your personal information may be disclosed to third-party service providers, including credit reference, liquidity (currency) providers, fraud prevention or financial crimes and payment processors of other institutions, and these institutions may fully respond to our inquiries. This is just an identity check and will not adversely affect your credit rating. In addition, we may ask you to wait for a period of time after the transaction is completed before allowing you to further use the HKC service and/or allow you to conduct transactions exceeding a certain number limit.

Trust digital currency Wallet.

General situation. Your hosted digital currency wallet enables you to store, track and manage supported digital currency in your hosted digital currency wallet. After verification according to our KYC/AML policy, you will be able to issue instructions through the website to request, send, receive and store digital currency from a third party (every such transaction is a "digital currency transaction").

HKC has the right to refuse to handle or cancel any pending digital currency transaction according to legal requirements or subpoenas, court orders or other government requirements, or to enforce transaction restrictions according to its judgment. HKC cannot cancel the digital currency transaction that has been submitted to digital currency Network. Hosted digital currency Wallet Service is only applicable to digital currency, which is supported by HKC at its sole discretion, and HKC may change such support at any time. If you have any questions about the digital currency currently supported by HKC, please visit the website. Under no circumstances should you attempt to use your hosted digital currency wallet service to store, send, request or receive any form of digital currency that is not supported by HKC. HKC assumes no responsibility or obligation for any attempt to use HKC services in digital currency that HKC does not support.

3.2. The digital currency deal. HKC handles the supported digital currency according to the instructions received from its users, but we do not guarantee the identity of any recipient, requester or other party. You should verify all transaction information before submitting instructions to HKC. Once submitted to digital currency Network, the digital currency transaction will be unconfirmed for a period of time, waiting for digital currency Network to fully confirm the transaction. The transaction in the pending confirmation state is incomplete. Funds related to pending transactions will be designated accordingly, and will not be included in your HKC account balance, nor can they be used for transactions (or withdrawals). HKC reserves the right to delay any digital currency transaction if it believes that there is a risk of fraud or illegal activities.

3.3. digital currency storage and transmission delay. HKC stores all digital currency private keys by combining online and offline storage. Therefore, HKC may need to retrieve some information from offline storage in order to facilitate the digital currency transaction according to your instructions, which may delay the start or credit of the digital currency transaction, even though HKC will seek to start or execute all transactions as soon as possible. You acknowledge and agree that despite the efforts of HKC, the digital currency transaction facilitated by HKC may be delayed. HKC does not act as a custodian of money or funds, nor does it have a custodian license.

3.4. Third-party payment. HKC does not control or assume any responsibility for the delivery, quality, safety, legality or any other aspects of any goods or services that you may buy or sell from third parties (including other users of HKC services). HKC is not responsible for ensuring that the buyer or seller with whom you may deal will actually complete the transaction or have been authorized to do so. If you encounter problems with any goods or services purchased from or sold to a third party in connection with digital currency transferred by using HKC services, or if you have disputes with the third party, you must directly resolve the disputes with the third party. If you think that a third party has acted in a fraudulent, misleading or inappropriate way, or if you cannot fully resolve the dispute with the third party, you can inform HKC Support on the website so that we can consider taking any action.

3.5. Advanced agreements. Unless specifically announced on the website or through other official public statements of HKC, we do not support dollar coins, colored coins, side chains or other derivative, enhanced or bifurcated agreements, tokens or coins that supplement or interact with digital currency supported by HKC (collectively referred to as "advanced agreements"). Do not use your HKC account to try to receive, request, send, store or participate in any other type of transaction involving advanced agreements. HKC platform is not configured to detect and/or protect high-level protocol transactions, and HKC assumes no responsibility for high-level protocols.

3.6. Operation of digital currency Agreement. HKC does not own or control the underlying software protocols that manage the digital currency operations supported on our platform. Generally speaking, the underlying protocols are open source, and anyone can use, copy, modify and distribute them. By using the HKC platform, you acknowledge and agree that: (i) HKC is not responsible for the operation of the underlying protocol, and HKC does not guarantee its function, security or availability; And (ii) the operating rules of the underlying protocol may suddenly change (also known as "bifurcation"), and such bifurcation may have a significant impact on the value, function and/or even name of digital currency you store on the HKC platform. In the event of bifurcation, you agree that HKC can temporarily suspend HKC business (with or without prior notice to you), and HKC can decide whether to fully support (or stop supporting) any branch of the bifurcation agreement at its own discretion. You acknowledge and agree that HKC is not responsible for unsupported forking protocol branches.

Exchange rate conversion services and fees

4.1. You authorize HKC to initiate deduction from the payment method you choose to settle the purchase and/or sales transactions. The transaction fee defined in Section 4.2 applies to all purchase and sales transactions. Although HKC will try to deliver the supported digital currency to you as soon as possible, the payment method you choose may be deducted before digital currency delivers it to your HKC account. We may deduct money from the payment method you choose (such as your bank account or credit card) on the day you initiate the purchase or sale, but your payment may take longer to process. If HKC cannot fulfill your purchase or sales order, we will inform you and seek your approval to fulfill the purchase or sales order at the current quotation.

4.2. Every conversion service transaction needs to pay fees other than the quoted price ("transaction fees"), as well as other related fees, commissions, bank fees, wire transfer fees, clearing house fees, network fees (miners' fees), etc. ("related fees"), all of which are paid by you. The applicable transaction fee will be displayed on the website before you complete the conversion service transaction. The availability of each payment method depends on many factors, including but not limited to your location, the identity information you provided to us and the restrictions imposed by the third-party payment processor. You can check the current fees applicable to your location and payment method on our fees page.

You should understand that in order to purchase or sell cryptocurrency, HKC deals with various third parties and liquidity providers of cryptocurrency, and HKC holds accounts of these third parties and liquidity providers on behalf of HKC, including legal accounts, cryptocurrency accounts and digital wallets. You hereby acknowledge and agree that HKC holds your legal tender and cryptocurrency in the accounts of these third parties and liquidity providers.

You should also understand that the quotation that HKC receives from the liquidity provider of cryptocurrency for selling or buying cryptocurrency includes the price difference or deposit of HKC compared with the quotation that HKC offers you for selling or buying cryptocurrency.

You should also note that the quotation of cryptocurrencies for sale or purchase presented to you on this website as "market price" or otherwise as quotation for specific cryptocurrency transactions includes, among other things, the fees of liquidity providers and the fees of HKC for using this technology ("quotation"). Quotation can be calculated as the weighted prices of several different buyers or sellers provided by different liquidity providers and/or platforms. There may be a time difference between the conversion order and the actual conversion, which will affect the displayed price.

4.3. Deposit. In order to start any transaction of buying or selling digital currency, you must first keep enough funds in your HKC account, and deposit enough legal tender and/or cryptocurrency into your HKC account to pay for the transactions you need. Your deposit in digital currency shall be delivered to the escrow digital wallet belonging to our company, and such deposit shall be recorded under your HKC account. The funds in French currency should be deposited into the HKC bank account by bank wire transfer or credit card processing. Once we receive your deposit confirmation, such deposits will be recorded in your HKC account.

When you choose to deposit legal tender funds into your HKC account through credit card processing, as your credit card holder, you declare and confirm that you will always ensure that you comply with any and all applicable laws and regulations related to your credit card holding and use.

4.4. Refund or cancellation policy. You cannot cancel, cancel or change any transactions marked as completed or pending. If your payment is unsuccessful or your payment method has insufficient funds, you authorize HKC to cancel the transaction or deduct any amount needed to complete the transaction from your other payment methods (including the balance of HKC or other related accounts) at its own discretion. It is your responsibility to maintain sufficient balance and/or sufficient credit line to prevent your payment provider from charging overdraft fees, NSF fees or similar fees. HKC has the right to refuse to handle, cancel or cancel any digital currency purchase or sale at its own discretion, even if the funds have been deducted from your account, for reasons including but not limited to technical errors, market abuse or manipulation, or your failure to pass our KYC process, and under the following circumstances: (i) HKC suspects that the transaction involves (or is likely to involve) money laundering, terrorist financing, fraud or any other type of financial crime; (ii) responding to subpoenas, court orders or other government orders; (iii) HKC has reason to suspect that the transaction is wrong; Or (iv) HKC suspects that the transaction is related to the prohibited use or prohibited business described below. In this case, HKC will cancel the transaction, and we have no obligation to allow you to resume the purchase or sales order at the same price or terms as the cancellation. Any refund is at the discretion of HKC.

4.5. Withdrawal. At any time, you can make a withdrawal request to withdraw funds from your HKC account. According to your request and the company's approval after obtaining the necessary documents, the company should specify certain time periods of the day for actual withdrawal. Once approved, the company will deliver the applicable digital currency to the personal digital wallet designated by you, and declare that the wallet is your exclusive possession and under your full control. You acknowledge that any delivery in digital currency may not be carried out immediately or may be delayed. According to our compliance policy and bank requirements, after your request for withdrawal of legal tender funds, we may use the detailed information provided by you to deposit the funds into your credit card or initiate bank transfer to the bank account where you deposited the funds. All your withdrawals and financial activities on the HKC platform will be recorded under your HKC account. Please consider that we need up to three (3) working days to process your withdrawal request. It may take up to five (5) working days for the withdrawal to reach your credit card or bank account.

4.6. Payment Service Partner ("PSP"). HKC may use a third-party payment processor to process any US dollar (or other legal tender) payment between you and HKC, including but not limited to the payment related to your use of the conversion service. HKC cannot guarantee that PSP will accept all credit cards. The acceptability of your credit card depends on various factors, such as your location, your identity information, restrictions imposed by your credit card provider and/or third-party payment processors. Similarly, HKC cannot guarantee that your bank will accept funds received from your HKC account. It is your responsibility to ensure that your credit card provider or bank accepts your funds. You also acknowledge that HKC will provide PSP with some information and/or documents about you that may be needed to complete the transaction. With regard to any legal tender deposit, you further agree not to make or attempt to initiate deduction and/or refuse or cancel any deposit you have made. In any such case, we reserve the right to stop providing HKC services to you, terminate this agreement and take any further actions we think appropriate, including adjusting your HKC account to reflect the amount deducted from any deposit balance to offset any losses suffered due to your withdrawal or cancellation of the transaction.

General use, prohibition and termination of use.

5.1. Limited license. According to the terms of this agreement, HKC grants you a limited, revocable, non-exclusive and non-transferable license to access and use this website and related content, materials and information (collectively referred to as "content") for approved purposes permitted by HKC from time to time. Any other use of this website or content is expressly prohibited, and all other rights, ownership and interests are the exclusive property of HKC and its licensors. You agree that you will not copy, transmit, distribute, sell, license, reverse engineer, modify, publish or participate in the transfer or sale, create derivative works or use all or part of any content in any other way. "qcmcrypto.com", "HKC" and all logos related to HKC services or displayed on the website are trademarks or registered trademarks of HKC or its licensors. You may not copy, imitate or use them without the prior written consent of HKC.

5.2. Website accuracy. Although we intend to provide accurate and timely information on the website, the website (including but not limited to the content) may not always be completely accurate, complete or up-to-date, and may also include technical inaccuracies or typographical errors. In order to continue to provide you with complete and accurate information, we may change or update information from time to time, including but not limited to information about our policies, products and services, without prior notice. Therefore, you should verify all the information instead of relying on it. All decisions made based on the information contained in this website are your own responsibility, and we are not responsible for such decisions. Links to third-party materials (including but not limited to other websites) may be provided for convenience, but they are not under our control. You acknowledge and agree that we are not responsible for any aspect of information, content or services contained in any third-party materials or any third-party websites that can access or link to this website.

5.3. Third-party applications. If, within the scope permitted by access or connect to your HKC account through products or services of third parties or through this website, you acknowledge that allowing third parties to take specific actions on your behalf does not relieve you of any obligations under this Agreement. In addition, you are fully responsible for all actions or omissions of any third party to access your HKC account. In addition, you acknowledge and agree that you will not ask HKC to be responsible for any and all responsibilities, expenses, claims or damages caused by any actions or omissions arising from or related to any third party's access to your HKC account, and you will indemnify HKC from any damage. At any time, you can change or delete the permissions you granted to third parties about your HKC account through the account settings (integration) page on the website.

5.4. Use is prohibited. As far as your use of the HKC service is concerned, you agree and declare that you will not engage in any prohibited business or prohibited use as defined here. We reserve the right to monitor, review, retain and/or disclose any necessary information at any time to meet any applicable laws, regulations, sanctions plans, legal procedures or government requirements. We reserve the right to cancel and/or suspend your HKC account immediately and/or block transactions or freeze funds without prior notice if we decide that your HKC account is related to illegal use and/or illegal business.

5.5. Trading restrictions. The use of all HKC services is limited by the amount of transactions (in US dollars) that you can make or transfer in a given time (such as daily). To view your limit, please log in to your HKC account and visit the website. Your transaction limit may vary depending on your payment method, the verification steps you have completed and other factors. HKC reserves the right to change the applicable limit at our own discretion when we think it is necessary. If you want to increase your limit to exceed the published amount, you can submit an application on the website. We may ask you to submit additional information about yourself or your business, provide records, and arrange a meeting with HKC ex staff (this process is called "enhanced due diligence"). HKC reserves the right to charge you the costs and expenses related to "enhanced due diligence" provided that we inform you in advance. Even if you have completed the "enhanced due diligence" and paid the costs and expenses, we can still refuse to increase your limit or lower your limit at a later time at our sole discretion.

5.6. Suspension, termination and cancellation. HKC may (a) suspend, restrict or terminate your access to any or all HKC services; And/or (b) deactivate or cancel your HKC account when any one or more of the following happens:

We are required to do so by summons, court orders or orders of government authorities; or

We suspect that you are using your HKC account for prohibited purposes or business; or

The use of your HKC account is subject to any pending litigation, investigation or government procedures, and/or we believe that the risk of legal or regulatory violations related to your account activities increases; or

Our service partner cannot support your use; or

You take any action that HKC thinks circumvents HKC's control, including but not limited to opening multiple HKC accounts or abusing promotional activities that HKC may provide from time to time; or

You violate any one or more of our policies mentioned on this website, such as KYC/AML, privacy policy, etc.; or

You engage in any illegal or illegal activities; or

Violation of any important provision of this clause; or

You violate any money laundering regulations or KYC requirements.

If HKC suspends or closes your account for any reason, we will provide you with our notice of action, unless a court order or other legal procedures prohibit HKC from providing you with such notice. You acknowledge that HKC's decision to take certain actions, including restricting access, suspending or closing your account, may be based on confidentiality standards that are essential to HKC's risk management and security protocols. You agree that HKC has no obligation to disclose the details of its risk management and safety procedures to you.

Within ninety (90) days after the account is deactivated or cancelled, you will be allowed to transfer funds related to digital currency or your digital currency wallet, unless such transfer is prohibited: (i) legal provisions, including but not limited to the applicable sanctions plan; Or (ii) a summons or court order. You can close your HKC account at any time without being charged for closing your HKC account; However, you will be required to cancel or suspend any pending transactions when closing. HKC will not be responsible for any loss you suffer due to any modification of any HKC service or suspension or termination of your access to any HKC service in whole or in part (whether according to this section or for any other reason). If and when the HKC service is resumed, you acknowledge that the valuation and exchange rate of tokens may be very different from those before the event.

If you are a consumer, you acknowledge that the right of withdrawal does not apply to you, because the price of HKC services depends on fluctuations in financial markets beyond HKC's control and may occur during the withdrawal period.

5.7. Relationship between the two parties. HKC is an independent contractor for all purposes. Nothing in this Agreement shall be deemed or intended to be deemed to cause you and HKC to be regarded as partners, joint ventures or other profit-making co-partners, employers/employees, or you or HKC to be regarded as agents of the other party.

5.8. Others' privacy; Marketing. If you receive information from other users through the HKC service, you must keep the information confidential. You shall not disclose or distribute the user's information to a third party or use it unless you get the explicit consent of the user. You must not send unsolicited e-mail to users through the HKC service.

5.9. Password security; Contact information. You are responsible for maintaining adequate security and control over any and all IDs, passwords, tips, personal identification numbers (PIN), API keys or any other codes that you use to access the HKC service. Any loss or disclosure of the above information and/or your personal information may lead to the unauthorized access of a third party to your HKC account, and the loss or theft of any digital currency and/or funds held in your HKC account and any associated account (including your associated bank account and credit card). It is your responsibility to update your email address and telephone number in your account information to receive any notices or alerts that we may send you. We are not responsible for any losses caused by your failure to update in time or the disclosure of account login credentials and/or your failure to follow or execute any notice or reminder that we may send you. If you think your HKC account information has been leaked, please contact the HKC support department at support@HKC.exchange immediately.

5.10. Abide by the law; Tax. You are responsible for (1) observing all applicable laws related to your trading activities and use of HKC services; And (2) to determine whether and to what extent any tax is applicable to any transaction you conduct through the HKC service or any transaction related to your activities under this Agreement and terms; And (3) withholding, collecting, reporting, paying and remitting the correct taxes to the appropriate tax authorities. Your transaction history can be obtained through your HKC account.

5.11. Unclaimed property. If HKC holds funds in your account but HKC cannot contact you, and there is no record of your use of HKC services for more than six (6) months or longer, applicable laws may require HKC to report these funds to the applicable jurisdiction as unclaimed property. If this happens, HKC will try to find you at the address shown in our records, but if HKC cannot find you, it may be required to deliver any such funds to the applicable state or jurisdiction as unclaimed property. You know and agree to this. HKC reserves the right to deduct Euro10 per month or the equivalent of digital currency dormancy fee and/or other management fees allowed by applicable laws from such unclaimed funds after six (6) months. If the customer has died, the company will produce the succession order/certificate or probate according to the applicable laws.

Customer feedback, inquiry, complaint and dispute resolution

6.1. Contact HKC to provide you with the best service and always maintain the highest standards. If you are dissatisfied with our HKC service for any reason, we have established an internal procedure to handle all complaints fairly and promptly. Please contact us by email, preferably in writing: complaints@HKC.exchange Once your complaint is received, the complaint section of our customer support department will handle and investigate the complaint. We will confirm the receipt of your complaint by email in time and provide you with the complaint reference number. For your convenience, please be sure to use this reference number when contacting us and any other regulatory agencies to handle specific complaints in the future. We will carefully examine your complaint, investigate the situation related to your complaint, and do our best to solve your complaint in time. We will make every effort to provide you with the investigation results within four (4) weeks from the date of receiving the complaint. We will keep you informed of the progress during the investigation. Our representative may contact you directly to obtain further explanation, information and/or evidence related to the complaint. In order to effectively handle this claim, we need your full cooperation and attention. If we can't solve your complaint within eight (8) weeks, we will inform you of the delay. The notice will explain the reasons for the delay and the estimated time for completing the investigation. Please note that if you don't reply to our email or telephone within three (3) months from the date of submitting your complaint, the company will consider your complaint as finally completed and closed.

We will inform you of the final investigation results and explain the company's position and any remedial measures we intend to take (if applicable).

If we can't answer your question within eight (8) weeks, or you are still not satisfied with our proposed solution, you can also complain to the appropriate government agencies.

6.2. Dispute settlement; Governing law; Give up the class action lawsuit.

If you have a dispute with HKC, we will first try to resolve any such dispute in a friendly way through our support team.

General rules.

7.1. Computer virus. We are not responsible for any computer virus, spyware, threatening software, Trojan horse, worm or other malicious software that may affect your computer or other equipment, or any phishing, deception or other attacks, or any damage or interruption caused by force majeure or other disasters, unplanned maintenance or any other reasons beyond our control. We recommend that you regularly use reputable and readily available virus screening and prevention software. You should also understand that SMS and email services are vulnerable to fraud and phishing attacks, and you should be careful when reviewing information claiming to come from HKC. You are responsible for backing up and maintaining copies of any information you store or transmit through the HKC service. If you are in any doubt about the authenticity of any communication or notification, please always log in to your HKC account through the website to view any transactions or required actions.

7.2. Exemption from HKC; Compensation. If you have a dispute with one or more users of the HKC service, you shall exempt HKC, its affiliates and service providers, as well as their respective senior staff, directors, agents, joint ventures, employees and representatives from any and all claims, demands and damages of various nature (actual and indirect) arising from or related to such disputes in any way.

You agree to indemnify and hold HKC, its affiliates and service providers, and their or their respective officers, directors, shareholders, agents, joint ventures, employees, lawyers, suppliers, contractors and representatives ("Indemnitees") harmless from any claims, lawsuits, actions, procedures, investigations, responsibilities, damages, losses, costs, expenses or demands (including but not limited to reasonable). If you are obligated to compensate any indemnified party, HKC (or at the discretion of HKC the applicable indemnified party) will have the right to control the lawsuit or procedure at its own discretion, and decide whether HKC wants to settle, and if so, decide the terms of the settlement.

7.3. Limitation of liability; Disclaimer of damages; No guarantee.

7.6. Transfer. You may not assign or transfer any rights and/or licenses granted under this Agreement without the express written consent of HKC, which has the right to decide at its own discretion. We reserve the right to assign or transfer our rights without restriction, including but not limited to any HKC affiliate or subsidiary or any successor in interest in any business related to HKC services. Any attempt to transfer or transfer in violation of this agreement is null and void. 7.11. English language control. Notwithstanding any other provisions of this Agreement, any translation of this Agreement is provided only for your convenience. The meanings of terms, conditions and expressions in this agreement are limited by English definitions and interpretations. If there is any discrepancy between the non-English version of this Agreement and the version of this Agreement, the English version shall prevail.

These countries include Afghanistan, Algeria, Bahamas, Bangladesh, Bolivia, Botswana, Burundi, China (Mainland), Cambodia, Canada, Congo, Crimea, Cuba, Egypt, Ethiopia, Ghana, Japan, Iran, Iraq, Lebanon, Libya, Mali, Myanmar, Morocco, Nepal, Nicaragua, North Korea, Pakistan, Panama, and so on.

9. The government or law enforcement agencies may ask us to provide information to assist law enforcement agencies in investigating, tracking and preventing illegal activities.
